Man is charged with shooting at sheriff, sentence suspended

An Apex man charged in October 2008 with the attempted murder of Alleghany Sheriff David "Squeak" Edwards was found guilty of discharging a weapon into an occupied property during the August 10-12 session of Alleghany Criminal Superior Court. The session was presided over by Judge Edgar B. Gregory.

According to information previously published in The Alleghany News, Charles Holt Young III, then 35, was charged Oct. 2, 2008 with attempting to kill Edwards and assaulting a law officer with the use of a Glock 30 (.45 caliber) semi-automatic pistol by firing the weapon at Edwards narrowly missing him. At the time, Edwards was investigating a right-of-way dispute. Charges of assault with a deadly weapon with intent to kill and assault of a law enforcement officer with a firearm were dismissed.

For the charge of discharging a weapon into an occupied property, Young was sentenced to no less than 20 and no more than 33 months suspended 36 months, was ordered to pay $1,000 fine and court cost, do 100 hours community service and pay fee within six months, have supervised probation for 36 months and to forfeit all his weapons to the Alleghany Sheriff's office. In addition, Young was ordered to submit to warrantless searches, not use, possess or control any illegal drug or controlled substance unless prescribed, supply a breath, urine and/or blood specimen for analysis of the possible presence of a prohibited drug or alcohol, as well being ordered not to possess or purchase firearms or hunting bows, have DNA testing within 21 days, submit to fingerprinting and have his hunting privileges revoked. Young's conviction information and probation were transferred to Wake County.

Other cases heard during the recent session of criminal superior court are listed below.

Criminal Superior

Allen G. Andrews, felony probation violation out of county, admit, willful violation, continue on probation, same conditions and additional 72 hours jail at direction of probation officer within 30 days at least 24 hours straight or be picked up and served straight, if tested positive be arrested immediately. Felony probation violation out of county, willful violation, continue on probation, 30 days current in money or arrested.

Raul Lara Arias, attempted statutory sex offense (against a person) 13 years of age, no less than 158 months and no more than 198 months in department of corrections, order department of corrections to do assessment, register as a sex offender, participate in sex abuse treatment in department of corrections, pay $1,087 court-appointed attorney fee, findings of fact include: the defendant convicted of a sexually violent offense, defendant not classified as a sexually violent predator, not a recidivist, offense of conviction not an aggravated offense, offense of conviction did involve physical, mental, sexual abuse of a minor, the defendant was ordered to undergo satellite-based monitoring, the department of corrections was ordered to fill out and complete static 99 and present it to the presiding judge on Oct. 12, the defendant is to be brought back for a hearing by the department of corrections and an interpreter be present.
