Lawsuit against town gets mediation

A complaint filed by two Alleghany men against members of the Sparta Town Council has a mediated settlement conference deadline of Sept. 5 and a trial date of Oct. 12, according to a document on file May 14 at the Alleghany County Clerk of Court Office. Larry D. McCann and Mark Robert Richardson filed a complaint against Council members Robert Andrews, John Brady, Mike Parlier, Lois Sheets, of and for the board of aldermen and the town of Sparta.

Complaint

According to a document filed April 1, The complaint dates back to May 11, 2006, when McCann and Richardson discovered a municipal sewage backup that they claim entered and destroyed McCann's property on West Whitehead Street. At the time, Richardson was a tenant of said residence, but he had not been there in several weeks, the complaint said.

The document stated the representatives of the Town of Sparta "blamed the destruction…on a grease blockage of the Town's main sewer line."
