May facing additional charges after Grand Jury convenes here

An Alleghany man is now facing additional charges after indictments against him were handed down in Alleghany Superior Court last week. Henry Mason May II, 38, was facing three statutory rape charges and one statutory sex offense prior to the court session, but was indicted by an Alleghany County Grand Jury last week with seven additional charges all involving the same victim, a girl who was 13 at the time the incidents are alleged to have occurred.
An indictment represents probable cause to move forward with a court case, not a finding of guilt. May, through Sparta Attorney Donna Shumate, pled not guilty to all the charges.
The court session was held April 28 and April 29 and was presided over by Superior Court Judge Henry E. Frye Jr. The prosecutors during the session were Assistant District Attorneys John W. Sherrill and Stacy Y. Adams.
May's case was continued until the week of Aug. 11, according to the district attorney's office.
May was initially charged on April 1, 2006 with three counts of statutory rape where the defendant was six or more years older than the victim, and one count of statutory sex offense against a then-13-year-old girl.
At the time of the 2006 charges, May was placed under a $100,000 secured bond and has remained in the Alleghany County Jail since that time awaiting trial.
The additional charges included three counts of crimes against nature and one count of indecent liberties with a child. In addition, May was charged with three counts of statutory sex offense, one of which was listed as superseding an earlier indictment.
During the March 24 term of Alleghany Superior Court, which also was presided over by Judge Frye, May was indicted as a habitual felon and was placed under an additional $150,000 secured bond for that charge. The $100,000 secured bond under which May was initially placed also was increased at that session to $150,000 secured, bringing his total bond to $300,000.
Assistant District Attorney Stacy Adams said May is charged with having intercourse with the girl as well as doing other sexual acts with her. Under the guidelines, a person 13, 14 or 15 years old cannot legally consent to sexual activity. The charges are counted as more severe if the alleged perpetrator is at least six years older than the victim. All of the charges are felonies.
Adams noted should May be found guilty of the felonies, because of his habitual felon status, he will be sentenced more severely than an individual with no prior criminal record.

Thomas Lennie Andrews, taking wild turkey by unlawful means, prayer for judgment continued, court cost remitted. Hunting from a motor vehicle, dismissed;
Ronald Ray Billings, possession of stolen goods, no less than 11 and no more than 14 months in the Department of Corrections, credit for time served. Breaking and/or entering, dismissed. Larceny of chose in action, obtaining property under false pretenses, giving fictitious information to an officer, speeding, driving while license revoked, no less than 11 and no more than 14 months at the expiration of the stolen goods sentence, suspended 48 months; supervised probation ordered. Forgery of instrument, uttering forged instrument, no less than eight and no more than 10 months to be served at the expiration of the other sentence, suspended 48 months, report to probation officer after release. Intensive probation ordered for the first six months, community service requirement waived. Billings was ordered to submit to warrantless searches and not to use, possess or control any illegal drug or controlled substance unless prescribed to him, submit to drug and alcohol testing, enroll in Serenity House.
