Love's plea deal declined by judge

Judge A. Moses Massey turned down Lonnie Dale Love's plea
arrangement, during Criminal Superior Court held the week of Oct. 8
at the Alleghany County Courthouse.
Love, through attorney Donna Shumate, had reached a plea deal with
District Attorney Tom Horner's office, according to Assistant
District Attorney Stacy Y. Adams.
Under the terms of the deal, Love would plead guilty to second-degree
murder and agree to serve a minimum of 180 months and a maximum of
225 months in prison, with credit for time served.
When Massey said he would not accept the plea, Love withdrew his
guilty plea.
In May 2006, Love, then 33, and co-defendant Billy Joe Bare, then 26,
were charged first-degree murder, conspiring to commit murder,
breaking and/or entering and robbery with a dangerous weapon after
the body of Juan Jose Castro Lopez was found near a mobile home that
he had rented on Chevy Lane, off N.C. 18 south of Sparta.
During an August trial presided over by Massey, Bare was found guilty
of first-degree murder and sentenced to life in prison. Bare filed a
notice of appeal in the case.
Love's testimony was key in Bare's conviction in the murder case.
Love's case has been continued until the March 24, 2008 session of
Alleghany County Superior Court.

Sherrill and Adams.
Robert Wayne Dalton, H/I felony probation violation, willful
violation, continue on probation, comply with existing terms of
probation, 10 days active schedule to be determined by probation
officer by at least March 2008.
William Webb, felony probation violation out of county, willful
violation, probation terminated, activate no less than eight and no
more than 10 months in the department of corrections, less jail
credit, DART or other substance abuse treatment, civil judgment, pay
$390 court-appointed attorney fee.
