Superior Court session is finished by Tuesday

A short session of Alleghany Superior Court started Monday and ended mid-afternoon Tuesday.

Potential jurors were dismissed Monday, said Assistant District Attorney Stacy Adams. No jury trials were held.

Adams said some cases were set for a later date because prosecuting attorney Graham Green was called away for National Guard duty in Germany.

"He's just gone for two weeks," Adams said. It is an annual two-week duty assignment and this one happened to coincide with this Superior Court session, she explained.

Superior Court is held twice a year in Alleghany.

Judge Melzer A. Morgan Jr. presided over this session and prosecutors were District Attorney Tom E. Horner and Assistant District Attorneys Richard Lyle and Stacy Adams.

Cases heard are as follows.

Sergio Hernandez, indecent liberties with a minor child, second degree kidnapping, 20-33 months in prison suspended three years, 70 days in jail, credit for time served, intensive probation six months, supervised probation 2 and 1/2 years, $750 fine, court costs, submit to search for stolen property or contraband, not use, possess or control illegal substances, submit to random drug testing, 100 hours community service, pay fee, register as a sex offender, comply with treatment recommended by probation officer, pay $50 interpreter fee, have no contact with the victim, if any contact is made the defendant will serve 33 months in prison.

David Hurst Higgins, two counts possession of stolen goods, 45 days suspended two years, unsupervised probation, $9,600 restitution, court costs, each party to stay away from the other, have no contact with victim or family for two years.

Ronnie Gene Roten, breaking and entering, 6-8 months in prison, credit for time served, pay $130 for court appointed attorney.

Jenny G. Billings, misdemeanor child abuse, resisting a public officer, 45 days suspended with supervised probation 14 months, $300 fine, court costs, 50 hours community service.
