Three motions in a lawsuit involving Alleghany County, the Town of Sparta and other entities versus Bristol Compressors are scheduled to be heard in Alleghany County Superior Court on Monday.
All three motions were filed by attorneys for the defendants, officially listed as York International Corporation, Bristol Compressors Sparta Inc. and Bristol Compressors Inc. Bristol is represented by attorneys William K. Davis and Alan M. Ruley of Bell, Davis & Pitt, P.A. of Winston-Salem.
Alleghany County is represented by Ernest C. Pearson of The Sanford Holshouser Law Firm of Raleigh.
One motion was directed at Pearson, to wit, requesting that he be deposed for material facts in the case. The motion asks the court to compel Pearson to testify because he represented the local entities and was the principal author of the incentive agreement that was negotiated in 1993.
According to the motion, "As the principal author of the incentive agreement, Mr. Pearson obviously has knowledge material to the dispute here, such as why the agreement was drafted the way it was, why certain provisions were included, why certain provisions were modified or deleted and the like. As the author of the document, only Mr. Pearson can explain why it was drafted the way it was."
A second motion is for summary judgement, which would basically lead to
the dismissal of the lawsuit.
