Fortis Suit May Go To Federal Court

Fortis Benefits Insurance Company, a Missouri-based firm, is suing the bank over its handling of checks deposited by the late Loyd Toliver. The suit was filed July 31.

On Sept. 10, attorneys Stephen D. Poe and Kevin G. Williams of Winston-Salem filed a notice of removal of civil action on behalf of First Community Bank. The notice seeks to remove the action from the Superior Court of the State of North Carolina, County of Alleghany, to the U.S. District Court for the Western District in North Carolina. The notice was filed at the western district office in Statesville, with a copy filed at the Alleghany Country Courthouse.
