A local resident is suing the school board over injuries from a fall about three years ago at Alleghany High School.
The Evelyn G. Miller and Lowell Miller versus Alleghany County Board of Education lawsuit complaint was filed Feb. 25 at the Alleghany County Courthouse.
According to the suit papers, filed by the Millers' attorneys, Benjamin G. Hurley Jr. and John T. Kilby of West Jefferson, the incident occurred May 30, 2000. The Millers, who are wife and husband, were visiting AHS to attend an awards day ceremony which included their son, Christopher Thomas Miller, who was then a student there.
After the awards ceremony, the suit states, the Millers were walking in a grassed common area in front of the school gymnasium when Evelyn Miller stepped into an earthen hole covered by grass and fell. Her right arm and elbow region were severely injured in the fall.
Miller was first attended by Dr. John Kovacich, who was also present at the awards ceremony, then taken to Alleghany Memorial Hospital. She was subsequently treated at Davis Medical Center in Statesville and underwent surgeries at that time and a year later.
Negligence Charged
The Millers are accusing the board, including those employed by the board, of negligence. The suit alleges that the hole had existed for about a year and that school officials knew about the hole and its danger.
