Bristol Compressors' parent company, York International filed a response on Sept. 23 to a lawsuit filed against it by Alleghany County, the Town of Sparta and three other local entities in Alleghany County Superior Court Aug. 15.
The local entities filed the suit in an attempt to recoup incentive monies paid to Bristol Compressors.
Also joining the county in the case are the Town of Sparta, Skyline Telephone Membership Corporation, Blue Ridge Electric Membership Corporation and Region D Development Corporation.
In their response to the suit, York International asked that defendants Bristol Compressors and Bristol Compressors of Sparta be dropped from the suit and further denied all charges against it made in the suit. York is being represented by attornies William K. Davis and Alan M. Ruley of Bell, Davis and Pitt, P.A. of Winston-Salem.
In its defense, York stated that the complaint fails to state a claim upon which relief may be granted. In addition, York claims that the complaint is "based upon an erroneous theory that the (incentive) agreement was terminated as provided therein. It was not, and according Plaintiffs' contract-based claims fail."
York states in the response that it performed its obligations under the agreement.
