Tony Greene, through his attorney, last week filed his response to the Alleghany County Board of Education's lawsuit against him, denying the board's accusations of breach of contract and negligence.
Greene is owner of T. Greene Plumbing Company (also known as T. Greene Electrical & Plumbing), which was the plumbing contractor for the construction of the new east wing of Alleghany High School, which includes the school's new gymnasium. The opening of the gym was delayed for a year, after a water heater leak caused damage to the floor in July 2001. AHS began using the classroom portion of the east wing in August 2001, while the gym was not open until last month, after the damaged floor was replaced.
The board filed the suit July 1 against Greene and Gulf Insurance Company — which issued the performance bond for Greene's work — to recover the cost of replacing the gym floor, listed at $84,869, along with associated expenses.
