Commissioners approve subdivision ordinance by 5-0 vote

The Alleghany County Board of Commissioners voted unanimously Monday to approve a subdivision ordinance.

The ordinance will officially take effect on July 13, 2002.

The commissioners voted on the ordinance after a brief discussion, including a few questions by commissioners.

Commissioner Charity Gambill asked if the ordinance would in any way take away the rights of the citizens to divide their property before or after death.

County Planner Jack Conaway responded that the ordinance would not do that. Furthermore, he said the county could not take away people's rights to divide their property.

Commissioner Patrick Woodie said the ordinance was a good one. "We've worked long and hard on this. Is it a perfect ordinance? Probably not. But is it a good ordinance? Absolutely. I'm sure there are things we may need to look at in the future," he said.

Following a motion by Woodie and a second by Commissioner J. Warren Taylor, Commissioner Eldon Edwards asked that anyone in the room who had not had the opportunity to speak be allowed to do so. "In my opinion, if there's someone here today that hasn't been here in the past and had an opportunity to speak," Edwards said, "I think we should listen to their comments." Chair Ken Richardson granted that request, but no one in the audience chose to speak. The conference room where the meeting was held was nearly full.

Gambill then asked if changes could be made to the ordinance in the future. Conaway said the document would not be difficult to amend or adjust. "It is a living document meant to adjust with time, not unlike our Constitution," he said.

"My understanding is that Ashe County just made changes to its ordinance after two years," Woodie added.

"I'm very pleased that it was approved. It's a great day for the citizens, property owners and visitors of Alleghany County," said Conaway in an interview Tuesday.
