Toliver’s court date is April 16

Kim C. Toliver's court appearance on embezzlement charges is now scheduled for April 16.

Toliver and her husband, Loyd Craig Toliver, were each charged last October with 16 counts of embezzlement, in connection with their employment at Grandview Memorial Funeral Home. The couple was accused earlier of stealing more than $74,000 from the funeral home between April 1995 and August 2001.

Det. Ricky Lyall of the Alleghany County Sheriff's Department said Tuesday that he could not comment on the case, but did say that the investigation is still continuing into the alleged embezzlement. Lyall said that the N.C. State Bureau of Investigation has been called in to assist the sheriff's department.

"The SBI has been working on the case since late last year," he said. "We are continuing to look into this matter with their help, but we can't really say anything else right now."

Loyd Toliver passed away Nov. 27, 2001, and the charges against him therefore were abated by the court the next month.

Kim Toliver's 16 charges were on the administrative calendar of last week's session of Alleghany County Criminal Superior Court, but the case was instead continued until the April 16 date.

Assistant District Attorney Stacy Adams said Toliver is scheduled for a probable cause hearing then.

"That's the most that could happen that date, a hearing to see if there's enough evidence to take it up to superior court."

Toliver has the option of waiving the probable cause hearing. If she does so, or if probable cause is found, a trial would be scheduled for a subsequent date, Adams said.

Additional charges against Toliver are possible in the case, said Adams. She explained that is why Toliver's charges did not go to the grand jury.
